Vanilla Mochi's Online Terms of Service

Online Terms for any distributed accessory or model created by Vanilla Mochi. These rules may be subject to change without notice. Please check to make sure of the rules have not changed before using a part or model

WHAT TO KNOW

  • The usage of translation apps to read the terms is accepted, but please be careful of any mistranslations caused in the process

  • I (Vanilla Mochi/vanillaxmochi) am not responsible for any damage that may be caused with usage of this data. Please use with caution

  • Anything not originally created or designed by myself (Vanilla Mochi/vanillaxmochi) are secondary fan creations and are not made with the intent of copyright infringement

  • Anything created from preexisting series will follow the terms of service set in place by their creators and they will have to be followed alongside my own

  • Failure to adhere to the rules set in place will result in suspension of distribution with no chance of redistribution

  • By downloading and using my models/assets, you automatically agree to the Terms of Service written here. Appropriate actions will be taken against those who break the rules

ACCESSORY TERMS

  • Do not use the accessory for any R-16 (suggestive), R-18, or fetish works

  • Do not sell or make money off of the accessory

  • Redistribution the accessory is prohibited

  • Distribution of accessories is only allowed on a finished model. Distribution on an outfit base is prohibited

  • Do not take textures or sph’s

  • Do not reformat the accessory for any program except MMD and it's sister programs. Usage in VRChat is prohibited

  • Posting on sites outside of DeviantART, Twitter, Tumblr, Bluesky or YouTube is prohibited

  • Do not use the accessory to use with or train AI

  • Do not use the accessory for works devolving Yandere Simulator, any works by Vivziepop or with usage of any motion or model created by AnastasiaP BATIMBATIM/Anastasia Borisova

  • Do not use the accessory for works that may harm another such, as works with intents of homophobic, transphobic, islamaphobic, antisemite, zionist or racist messages

  • Editing is allowed such as recolors or adding morphs/sliders, but it should always remain as the part it was created as

  • You MUST credit me (Vanilla Mochi) when using the accessory

FAN CREATION TERMS

These terms are to be used in coincidence with the rules stated above

  • Do not use the accessory for any images or videos that may harm the reputation of the original source material

  • Any rules set in place by the creators of the original source material must be followed alongside my own

NOTE:
Please be aware of the differences in copyright and Fair Use laws between the United States and your home country. Many of my models use game ripped parts, so it is not advised for users within the Japanese MMD Community, or those who live in countries with similar copy right laws to use them

MODEL TERMS

  • Do not use the model for any images or videos that may harm the reputation of the original source material or creator

  • Do not use the model for any R-16 (suggestive), R-18, or fetish works

  • Do not sell or make money off of the model. Using the model to showcase commissioned or Pay to Use work (such a motion, camera, pose or stage data) is allowed

  • Do not take parts, textures or sph’s

  • Do not reformate the model for any program except MMD and it's sister programs. Usage in VRChat is prohibited

  • Posting on sites outside of DeviantART, Twitter, Tumblr, Bluesky or YouTube is prohibited

  • Do not use the model for works that may harm another such as works with intents of homophobic, transphobic, islamaphobic, antisemite, zionist or racist messages

  • Do not use the model to use with or train AI

  • Do not use the model for works devolving Yandere Simulator, any works by Vivziepop or with usage of any motion or model created by AnastasiaP BATIMBATIM/Anastasia Borisova

  • Redistribution and trading is prohibited

  • Sharing an edit of the model for collaboration is allowed, but only if both parties have the original model and it doesn't violate the rules of any secondary parts used to make the edit

  • Usage for BL, GL or HL is allowed, provided the render does not violate another rule and the rules of the second model allow it

  • Using the model as a background character in a crowd scene is allowed

  • You MUST credit TDA (unless stated otherwise) and myself (Vanilla Mochi) when using the model

EDITING TERMS

  • Taking parts is prohibited. All credits for each model can be found within the model's folder. If asked, a link can be provided to a part

  • Headswaps are prohibited

  • Distribution of an edited, public model is allowed as long as it remains the same character. Distribution of recolors must be approved by me on a case by case basis, unless a user has been given permission otherwise

  • Distribution of an edited private or list model is prohibited

Edits that are allowed:

  1. Costume changes (check the model's Read Me to see what recommended base to use)

  2. Recoloring is only possible if the colors of the outfit is being changed (some models may be except from this rule). Recoloring the entire model and calling it your OC is prohibited

  3. Any required edits to be used for usage with Raycast or NCHLShader

  4. Edits such as renaming bones or editing physics
